How Colorado decides two names are the same

This is where Colorado stands apart. The ending and small words like “the” or “a” are part of the comparison, so an existing “ABC LLC” doesn't block “ABC Limited Liability Company” (C.R.S. § 7-90-601). What doesn't separate two names is punctuation or capitalization. Trade names are a separate matter: they need not be unique.

When the LLC trades under another name

For a second name, file a Statement of Trade Name with the Secretary of State for $20; renewing costs $5 and withdrawing $10. Because trade names needn't be unique, another business can register the same one. Filing a trade name therefore doesn't reserve it for your LLC alone.
